Non-Subscribing User Agreement 1. GENERAL. There is no fee required to create a User Profile on www.pacersurveys.com Users have free access to: - Edit settiings; - Create & deploy their customized version of the pacerX survey; - Collect data from anyone given the survey access code; - Subscription fees and a separate agreement apply if or when a user decides they want to view their survey results. Privacy Policy 1. GENERAL. Your privacy is critically important to us. This privacy policy is aimed at increasing your confidence in the privacy and security of the personal information we obtain from you as part of our registration process on www.pacersurveys.com. However, please note that PACER Datsa Collection, LLC is not responsible for any use of your personal information in which you provide to third-party applications or websites that may be accessed via www.pacersurveys.com. We recommend that you review the privacy policy of any third-party applications or websites that you use. 2. COLLECTION OF PERSONAL INFORMATION In order to subscribe to our products you first have to create a user profile, where you are asked for personally identifiable information such as your name, address, email address, tphone number. By providing such information and checking the box on your profile page, you acknowledge and to consent to our using it in the manner described in this policy. You may withdraw your consent at any time by "unchecking" the acknowledgement box on your profile. This action will not terminate your profile, but it will prevent you from accessing any "Software as a Service" (SaaS) products to which you subscribe. Although PACER does not utilize cookie information, pages you have requested and your IP address may also be recorded by third parties from your browser, unbeknownst to PACER Data Collection, LLC as set out in this policy. 3. USE OF SURVEY INFORMATION PACER Data Collection, LLC will use survey data to calculate univariate and bivariate statistics, bug fixes and other similar data (“Survey Data”) acquired through our online surveys. PACER Data Collection LLC may use such Survey Data in any way, including, but not limited to, using, editing, altering, reproducing, publishing and/or distributing the Survey Data for any purpose, commercial or otherwise, provided that such Performance Data is stripped of all personal and/or corporate identifying information. 4. USE OF PERSONAL INFORMATION We use personal information to allow us to process your service requests, provide access to privileged areas of the Website, send out newsletters, personalize your visit to our Website, personalize your use of our Products, and enable us to improve the products and services we offer We may occasionally carry out market research and send you details of services and offers that we think may be of interest to you. If you do not wish to receive such information simply "uncheck" the appropriate box on your profile page. 5. DISCLOSURE OF PERSONAL INFORMATION We may provide information about you to our employees and agents in order to administer any accounts, products and services provided to you by PACER Data Collection, LLC. We will not disclose your personal information to any third party unless you have consented to such disclosure or where we are required to do so by law. Should you breach our terms and conditions or terms of use or if we are under a duty to disclose or share your personal data in order to comply with any legal obligation, we may disclose your information to a relevant authority. This may include exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.
